Terms of Service
Last updated: 9 July 2026
These Terms of Service ("Terms") are a legal agreement between you and [COMPANY LEGAL NAME — e.g. FlightClaim Ltd] ("FlightClaim", "we", "us", or "our") and govern your access to and use of the FlightClaim website and service (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service does
FlightClaim is an informational self-help tool for air passenger rights. It helps you assess whether a flight disruption may qualify for compensation under regulations such as Regulation (EC) No 261/2004, UK261, and US Department of Transportation rules, and it helps you prepare a compensation demand letter that you submit yourself directly to the airline. The Service does not file, negotiate, or pursue claims on your behalf and does not collect compensation for you.
2. Not legal advice
FlightClaim is not a law firm and does not provide legal advice. Using the Service does not create a lawyer–client relationship. Eligibility assessments and letters are generated in part by automated systems, may be inaccurate, and are provided for general information only. Please read our Disclaimer, which forms part of these Terms. You are responsible for reviewing and verifying all output before relying on it or sending it to any airline or authority.
3. Eligibility to use the Service
You must be at least 18 years old and able to form a binding contract to use the Service. You may only submit information about flights and passengers that you are authorised to submit.
4. Your account
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You agree to provide accurate, current, and complete information and to keep it up to date.
- Notify us promptly at [CONTACT EMAIL — e.g. hello@flightclaim.com] if you suspect unauthorised use of your account.
5. Acceptable use
You agree not to:
- use the Service for any unlawful, fraudulent, or misleading purpose, or to submit information you know to be false;
- submit another person's personal data without a lawful basis and, where required, their authorisation;
- attempt to access, probe, or disrupt the Service, its infrastructure, or other users' data, or circumvent security or access controls;
- reverse engineer, scrape, or copy the Service, or use it to build a competing product;
- use automated means to overload the Service, or abuse, resell, or excessively consume the underlying AI or data features (including using the Service as a general-purpose AI tool unrelated to a flight-compensation matter); or
- infringe our or any third party's intellectual property rights.
We may suspend or terminate accounts that violate these Terms or that create risk or legal exposure for us or others.
6. Fees
The Service is currently provided free of charge. We may introduce fees or paid features in the future; if we do, we will make the pricing and terms clear before you incur any charge, and continued use of a paid feature will be subject to your acceptance of those terms.
7. Intellectual property
The Service, including its software, content, and branding, is owned by [COMPANY LEGAL NAME — e.g. FlightClaim Ltd] or its licensors and is protected by applicable laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial purpose of pursuing your own flight compensation. The claim letter text generated for you is yours to use for that purpose.
8. Third-party services
The Service relies on third-party providers (for example, for authentication and hosting, flight data, and AI processing) and may link to third-party websites such as airline portals. We are not responsible for third-party services or content, and your use of them may be subject to their own terms.
9. Disclaimers of warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any assessment, amount, deadline, or letter it produces will be accurate, complete, or result in any compensation. This section applies to the fullest extent permitted by law and does not exclude any liability that cannot be excluded under applicable law.
10. Limitation of liability
To the fullest extent permitted by law, [COMPANY LEGAL NAME — e.g. FlightClaim Ltd] and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of a claim, compensation, deadline, profits, data, or goodwill, arising out of or relating to your use of (or inability to use) the Service. To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the event giving rise to the liability, or USD 100. Nothing in these Terms limits liability that cannot be limited under applicable law, including for death or personal injury caused by negligence or for fraud.
11. Indemnity
You agree to indemnify and hold harmless [COMPANY LEGAL NAME — e.g. FlightClaim Ltd] from and against any claims, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your breach of these Terms, or your submission of information you were not authorised to submit.
12. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (including sections 2, 7, 9, 10, and 11) will survive.
13. Changes to the Service or these Terms
We may modify the Service or these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, by updating the "Last updated" date and, where appropriate, by notice in the app or by email). Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing law and disputes
These Terms are governed by [GOVERNING LAW — e.g. the laws of England and Wales], without regard to conflict-of-laws rules. The [COURTS — e.g. the courts of England and Wales] will have jurisdiction over any dispute, except that mandatory consumer protections in your country of residence continue to apply.
15. Contact
Questions about these Terms can be sent to [CONTACT EMAIL — e.g. hello@flightclaim.com], or by post to [COMPANY LEGAL NAME — e.g. FlightClaim Ltd], [REGISTERED BUSINESS ADDRESS].
